Bakgrund:

Trots att barns rätt till delaktighet är skyddad av både barnkonventionen och svensk lag, visar forskning att denna rätt ofta förbises inom socialtjänstens myndighetsutövning riktad till barn. En ökad kunskap om strukturerade metoder och arbetssätt som möjliggör barns delaktighet krävs för att säkerställa att artikel 12 efterföljs i praktiken.

Syfte:

Att undersöka hur barnkonventionens artikel 12, barnets rätt att uttrycka sina åsikter och bli hörd i alla frågor som rör dem, bättre kan efterföljas inom socialtjänstens myndighetsutövning riktad till barn med stöd av Shiers delaktighetsmodell (2001).

Metod:

Systematisk litteraturöversikt med en kvalitativ ansats.

Resultat och slutsatser:

Resultatet visar att barns rätt att uttrycka sina åsikter och få dem beaktade ofta inte uppfylls i praktiken inom socialtjänstens myndighetsutövning riktad till barn. Avgörande hinder är avsaknad av tydliga riktlinjer, hög arbetsbelastning, personalomsättning samt bristfällig dokumentation av hur barns synpunkter påverkat beslutsfattandet. Delaktigheten tenderar att bli personberoende och riskerar att urholkas till en symbolisk handling utan reellt inflytande. Samtidigt framkommer metoder och arbetssätt som skapar förutsättningar för barns delaktighet såsom konkreta modeller, barnets tillgång till anpassad information utifrån ålder och mognad samt ett relationsskapande arbetssätt. För att barns delaktighet ska bli verklig krävs att socialtjänsten etablerar strukturer som inte bara tillåter utan förpliktigar delaktighet. Detta i enlighet med Shiers delaktighetsmodell (2001, s. 111) där öppningar, möjligheter och skyldigheter samverkar.

Background:

Although children’s right to participation is protected by both the Convention on the Rights of the Child and Swedish law, research shows that this right is frequently overlooked within the context of social services statutory work. Increased knowledge of structured methods and working approaches is needed to ensure that article 12 is applied in practice.

Purpose:

To examine how article 12 of the UN Convention on the Rights of the Child, the child’s right to express their views freely in all matters affecting the child, can be more effectively implemented within child-focused social services investigation units, using Shiers model of participation (2001) as an analytical framework.

Method:

A systematic literature review with a qualitative approach.

Results and Conclusions:

The result shows that children’s right to express their views and have them considered, is often not fulfilled in practice within statutory social work. Key barriers include a lack of clear guidelines, high workloads, staff turnover and insufficient documentation on how children's perspectives have influenced decision-making. Participation tends to become dependent on individual practitioners and risks being reduced to a symbolic act without real impact. Although, certain methods and approaches that promote participation were identified such as concrete participation models, access to age- and maturity appropriate information, and a relationship-based practice. For participation to be sincere, social services must establish structures that not only enable but also obligate participation. This aligns with Shiers model of participation (2001, p. 111), which emphasizes the interplay of openings, opportunities, and obligations.
